Welcome to FlashKing ("we," "our," or "us"). These Terms of Use govern your use of our website, application, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Definitions

• User Account: The personal account created by a user to access the Service.
• Content: All text, information, data, images, and other materials uploaded, downloaded, or appearing on the Service.
• User Content: Content that users upload, share, or create through the Service, including flashcards, multiple-choice questions, and other study materials.
• Administrators: The developers and maintainers of FlashKing who have access to the underlying systems.
• Third-Party Authentication: The external services (such as Google) used through NextAuth to authenticate users.

2. Development Status

FlashKing is currently in development. By using the Service, you acknowledge and agree to the following:

• The Service may contain bugs, errors, or other technical issues
• Features may be incomplete, change without notice, or be removed entirely
• The Service may experience downtime, interruptions, or performance issues
• Data loss or corruption may occur
• Security vulnerabilities may exist despite our best efforts

We strive to address issues promptly, but we may have limited resources to do so. Your patience and understanding are appreciated.

3. Account Registration and Security

3.1 Account Registration

To use certain features of the Service, you must register for an account. We use NextAuth and third-party authentication providers (such as Google) to manage user authentication securely. By creating an account, you agree to:

• Provide accurate and complete information during the registration process
• Maintain and update your information to keep it accurate and complete
• Follow the terms and policies of the third-party authentication provider you choose
• Not create multiple accounts or create accounts for others without permission

3.2 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. With our third-party authentication system:

• Your password is managed by the third-party authentication provider
• We only receive your basic profile information (name, username, and email)
• Administrators cannot access your authentication credentials
• Administrators can access non-sensitive data in your account (such as your flashcards and study materials)

You should use strong passwords and follow security best practices for the third-party authentication services you use to access FlashKing.

3.3 Account Termination

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

4. User Content

4.1 Your Content

You retain all rights to any Content you submit, post, or display on or through the Service. By submitting, posting, or displaying Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods.

Please be aware that Administrators can see all study materials, flashcards, and other content you create on the platform. We only have access to the profile information (name, username, and email) provided by the third-party authentication services you use.

4.2 Content Restrictions

You agree not to upload, share, or create Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
• Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity
• Constitutes unauthorized or unsolicited advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation
• Contains material that could be considered harmful, obscene, pornographic, indecent, lewd, suggestive, or otherwise objectionable

4.3 Content Removal

We reserve the right, but not the obligation, to remove any Content that violates these Terms or that we find objectionable.

4.4 No Backup Guarantee

Due to the developmental nature of FlashKing, we do not guarantee the persistence, backup, or integrity of any User Content. Users should maintain their own backups of any important content.

5. Intellectual Property

5.1 Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of FlashKing and its licensors. The Service is protected by copyright, trademark, and other laws of Ireland, the European Union, and foreign countries.

5.2 Trademarks

The FlashKing name and logo are trademarks of FlashKing. You agree not to display or use these trademarks in any manner without our prior written permission.

6. Third-Party Authentication

We use NextAuth and other third-party authentication providers to secure user accounts. By using these services through our platform, you acknowledge and agree that:

• Your authentication is handled by the third-party provider
• These third-party services have their own terms of service and privacy policies
• You will comply with those terms and policies
• We are not responsible for the security practices or content of those services
• We receive only limited information (name, username, email) from these services
• Issues with authentication may need to be resolved through the third-party provider

7. Subscription and Payment

7.1 Pricing Changes

As FlashKing is in development, all pricing plans, subscription features, and payment terms are subject to change. We reserve the right to modify, change, or update our pricing structure at any time. We will make reasonable efforts to notify users of significant changes, but it is your responsibility to check for updates.

7.2 Subscription Plans

When subscription services are made available, various plans may be offered for access to premium features. By subscribing to a premium plan, you agree to pay the subscription fees indicated at the time of purchase. Due to the developmental nature of the Service, the features included in each plan may change.

7.3 Billing

When payment processing is implemented, we may use third-party payment processors such as Stripe. Your payment information will be subject to the privacy policy and terms of service of these third-party processors. We do not store your full payment details on our servers, and our Administrators do not have access to sensitive payment information.

7.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will continue to have access to premium features until the end of your current billing period, after which access to premium features will be revoked.

7.5 Refunds

Refunds are provided at our discretion. If you encounter technical issues that prevent you from using paid features, please contact us with details of the problem. Each refund request will be evaluated on a case-by-case basis.

8. Limitations of Liability

To the maximum extent permitted by law, in no event shall FlashKing, its developers, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any bugs, errors, or technical issues in the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Loss or corruption of User Content
• Any interruption or cessation of the Service
• Any issues with third-party authentication providers

You expressly understand and agree that your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Given the developmental nature of FlashKing, you agree to assume all risks associated with its use.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. FlashKing expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will meet your specific requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• Bugs or errors will be corrected
• The results that may be obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
• Any errors in the Service will be corrected
• Third-party authentication services will always be available or function properly

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
